Terms and conditions covering all of TUXG Hosting's services

TUXG Hosting is the web hosting service offered by The UX Group, an IT Services Company.

All services provided by The UX Group may be used for lawful purposes only. Transmission, storage or presentation of any information, data or material in violation of the law is prohibited. Prohibited are sites that promote any illegal activity or present content that may be damaging to The UX Group's servers, or any other server on the Internet. Links to such materials are also prohibited. This includes, but is not limited to:

The subscriber agrees to indemnify and hold harmless The UX Group from any claims resulting from the use of service which damages the subscriber or any other party.

Traffic Usage

All account plans come with a predetermined amount of traffic allowance. If you come close to your quota you will be notified and be given the option to upgrade to the next higher plan. If this limit is reached you account will be inaccessible until the next hosting month.

IRC

We currently do not allow IRC or IRC bots to be operated on our servers.

Spamming

Sending unsolicited bulk and/or commercial information over the Internet. It is not only harmful because of its negative impact on consumer attitudes toward The UX Group, but also because it can overload The UX Group's network and disrupt service to The UX Group's subscribers. Also, maintaining an open SMTP relay is prohibited. When a complaint is received, The UX Group will investigate and shutdown the account that is spamming. Furthermore The UX Group reserves the right to prosecute for this violation.

Adult-Oriented Content

Pornography, explicit material and other adult content are not permitted to be stored on The UX Group's Servers.

Obscene Speech or Materials

Using The UX Group's network to advertise, transmit, store, post, display, or otherwise make available child pornography or obscene speech or material is prohibited. The UX Group is required by law to notify law enforcement agencies when it becomes aware of the presence of child pornography on or being transmitted through its network.

Illegal or Unauthorized Access to Other Computers or Networks

Accessing, illegally or without authorization, computers, accounts or networks belonging to another party, or attempting to penetrate security measures of another individual's system (often known as "cracking") is against The UX Group's terms of service. Also, any activity that may be used as a precursor to an attempted system penetration (i.e., port scan, stealth scan or other information-gathering activity) is against The UX Group's terms of service.

Distribution of Internet Viruses, Worms, Trojan Horses or Other Destructive Activities

Distributing information regarding the creation of and sending Internet viruses, worms, Trojan horses, pinging, flooding, mail bombing or denial of service attacks is against The UX Group's terms of Service. Also, activities that disrupt the use of or interfere with the ability of others to effectively use the network or any connected network, system, service or equipment is against The UX Group's term of service.

Server Abuse

Any attempt to undermine or cause harm to a server or customer of The UX Group is strictly prohibited. As our customer you are responsible for all your accounts. Should you violate the Terms of Services outlined within, your account will be cancelled without chance of refund.

Refusal of Service

We reserve the right to refuse, cancel or suspend service, at our sole discretion.

Resource Usage

Our shared hosting plans are based on shared servers, meaning that other customers will be using the server to host their site. If at any point, your resource usage begins to affect other customers' service, we will notify you and give you the option to upgrade to a semi-dedicated or dedicated service.

All sub-networks, distributive hosting sites, virtual private servers and dedicated servers of The UX Group must adhere to the above policies, with the exception of system resources in respect to dedicated servers.

Billing

By the Account Activation Date of each month or year, depending on the payment terms, The UX Group will have delivered, by e-mail, an invoice in accordance with the applicable Service Fees for services rendered for the current month/year. When an invoice is delivered to the client, payment should be made to TUXG Hosting by no later than the specified payment due date. If payment is not made by 7 days after the due date, The UX Group shall be entitled to immediately suspend the account for client's failure to make timely payments. In addition, a late payment penalty of 5% of invoice amount gets added to the outstanding amount. If payment is not received within 30 days, the account will be removed with all data lost.

Money back guarantee & refund policy

We offer a 30 day Money back guarantee if the client is not satisfied with their hosting experience with The UX Group.

Refunds

If client has paid for the services, The UX Group is unable to offer a refund, unless the level of service falls below those outlined in these terms and conditions and in the service level agreement (SLA). Unfortunately domain names cannot be refunded.

Cancellation Refunds

We do not refund partial half-yearly or yearly or bi-annual fees to accounts.

Refusal of Service

We reserve the right to refuse, cancel or suspend service, at our sole discretion, without notification, if it is within a breach of these terms of service.

Limitation of Liability

The UX Group shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from The UX Group's servers going off-line or being unavailable for any reason whatsoever. We cannot be held liable for any predicated estimate of profits which a client would have gained if their site was functioning.

Furthermore, The UX Group shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of The UX Group's servers.

Data Backup

The UX Group backs up all data held on our servers as per the backup frequency announced, excluding dedicated servers, and in the result of hard disk failure, we restore all content, however, we cannot be held responsible or liable for data loss and therefore recommend that all clients regularly backup their data.

Violations

Violations of these Acceptable Use Policies should be referred to info@tuxghosting.com. All complaints will be investigated promptly. Failure to follow any term or condition will be grounds for immediate account deactivation.

Disclaimer

The UX Group cannot be held liable for system down time, crashes or data loss. Certain services provided by TUXG Hosting are resold. Thus, certain equipment, routing, software and programming used by The UX Group are not directly owned or written by The UX Group. Moreover, The UX Group holds no responsibility for the use of our clients' accounts. Failure to comply with any terms or conditions will result in the automatic deactivation of the account in question.

Account Activation

By activating your account with The UX Group, you agree to the above policies and disclaimer. Upon requesting activation of an account, you are required to accept these policies, guidelines and disclaimer, and a copy of these documents are available online at Terms of Service, Acceptable Use Policy and Privacy.

NOTICE: If you sign up for an account and fail to comply with these terms, no refunds will be given. We will, however, advise you by e-mail or phone to provide you with an opportunity to correct the problem, before terminating and deleting your account in such cases.

Server Uptime Guarantee

The UX Group guarantees 99.9% service (http, ftp, pop, imap, smtp) uptime on all hosting plans. Should we fail to deliver this for any given calendar month, your account will be refunded a pro-rated amount for the duration of excessive downtime:

The UX Group reserves the right to amend any or all of the above policies, guidelines and disclaimer without notification. We also retain the right to increase any pricing and make changes to our account plans without notification.
